A man identified as Fernando “N” was placed in preventive detention after attacking his partner at Ejido Emiliano Zapata in the San Quintín area on June 3. The San Quintín Regional Prosecutor’s Office secured a formal binding to process on domestic violence charges following his arraignment.

Municipal police responded to a domestic violence call at the ejido, located along the agricultural corridor south of Ensenada. Officers found the victim with visible injuries and arrested Fernando at the scene.

Prosecutors Seek Pre-Trial Detention

A judge granted the prosecution’s request for preventive detention rather than releasing the suspect pending trial. Under Mexico’s criminal procedure code, prosecutors can request this measure when they consider the accused poses an ongoing threat to the victim. The presence of visible physical injuries on the woman supported the request.

Ejido Emiliano Zapata sits in the San Quintín Valley, roughly 300 kilometers (186 miles) south of Ensenada along the Transpeninsular Highway. The valley is one of Baja California’s major agricultural zones and home to a large seasonal worker population. San Quintín has grown steadily in recent years and now has its own regional prosecutor’s office to handle cases locally.

How Domestic Violence Cases Work in Baja California

In Baja California, domestic violence involving physical injury is treated as a criminal offense that allows immediate arrest without a warrant. Police can detain a suspect on the spot when they observe evidence of assault. The case then moves to the prosecutor’s office, which must present it before a judge within a set timeframe to formalize charges.

Preventive detention means Fernando “N” will remain in custody while the case proceeds through the courts. If convicted, domestic violence charges in Baja California can carry prison sentences of up to six years, depending on the severity of the injuries and other circumstances.
