A man has been formally charged and ordered held in preventive custody for the alleged sexual abuse of a minor at Playa El Chileno in Los Cabos. The incident took place on April 3, and the suspect was detained after the victim’s party filed an immediate complaint with authorities.

On April 5, prosecutors presented the accused before a judge at the Los Cabos Criminal Justice Center. The judge confirmed the arrest as lawful and ordered the suspect bound over for trial, with pretrial detention imposed while the case proceeds.

Swift Action During Holy Week

The arrest came just two days after the alleged crime, during what is typically one of the busiest stretches of the year at Los Cabos beaches. Holy Week, known as Semana Santa, draws large crowds of both domestic and international visitors to the resort corridor’s public shores.

Playa El Chileno sits along the Tourist Corridor between San José del Cabo and Cabo San Lucas. The beach is one of only a handful in the area that holds Blue Flag certification for water quality and safety standards. It is a frequent stop for families, snorkelers, and day-trippers, with lifeguard service and public restroom facilities on site.

Pretrial Detention Ordered

Under Mexico’s criminal justice system, the formal binding to process (known as “vinculación a proceso”) means a judge found sufficient evidence to move the case forward. Pretrial detention, or “prisión preventiva,” keeps the accused in custody until trial rather than allowing release on bail. Mexican law mandates this measure for certain serious offenses, including sexual crimes against minors.

The Baja California Sur state prosecutor’s office (FGE, or Fiscalía General del Estado) handled the investigation and presented the case. The suspect’s name was not released in the initial report.

Authorities have not disclosed the age of the victim or the relationship, if any, between the suspect and the minor. The case will now proceed through the state court system in Los Cabos.
