Prosecutors in Mexicali have formally charged a man identified as Luis Antonio with aggravated sexual abuse of a minor in the Colonia Progreso neighborhood, according to Baja California’s Fiscalía General del Estado (FGE), the state attorney general’s office.

The case was brought by the FGE’s specialized unit on gender-based crimes. Investigators say the suspect exploited the family’s trust to gain access to the child, then threatened to harm her younger brother if she disclosed the abuse.

Judge Orders Preventive Detention

A control judge ordered Luis Antonio held in preventive detention while the investigation continues. The court also granted prosecutors a two-month window to complete their complementary investigation before the case moves forward.

Under Mexico’s criminal justice system, preventive detention means the suspect will remain in custody for the duration of the investigation period. Complementary investigation is the phase during which prosecutors gather additional evidence, interview witnesses, and build their formal case before trial.

Aggravated Charges Reflect Severity

The charge of aggravated sexual abuse carries heavier penalties than standard sexual abuse under Baja California’s penal code. The aggravated designation applies in cases involving minors, the use of threats or coercion, or when the perpetrator exploits a position of trust or authority over the victim.

Colonia Progreso is a residential neighborhood in central Mexicali, the capital of Baja California. The city sits directly across the border from Calexico, California.

The FGE did not release the victim’s age or further details about the suspect’s relationship to the family, citing protections for the minor’s identity. No additional suspects have been named in the case.
