A control judge in Ensenada ordered preventive detention for a man identified as Mauricio “N” after formally linking him to criminal proceedings on charges of attempted feminicide. The attack took place on May 15 in the Santa Anita neighborhood on Ensenada’s east side.

According to prosecutors, Mauricio went to his ex-partner’s home and stabbed her. The victim’s children intervened during the assault and were able to rescue their mother before the attack turned fatal. The woman survived.

Specialized Prosecutor Builds the Case

The Fiscalía Especializada en Delitos de Violencia de Género contra la Mujer, Baja California’s Specialized Prosecutor’s Office for Gender-Based Violence Against Women, presented evidence and witness testimony to the control judge. The judge determined the case was strong enough to formally bind Mauricio to trial.

Under Mexican law, the charge of attempted feminicide carries serious weight. Mexico’s feminicide statutes apply not only to completed killings but also to attempted murders when the victim is targeted because of her gender or the attack occurs within a context of domestic or intimate-partner violence. The distinction matters because feminicide charges carry heavier penalties than standard assault or attempted homicide.

Preventive Detention During Trial

The judge ordered prisión preventiva, meaning Mauricio will remain in custody for the duration of legal proceedings. In Mexico’s criminal justice system, preventive detention is typically reserved for charges classified as serious offenses. Attempted feminicide falls into that category under Baja California’s penal code.

The case will now move through the investigation phase, during which prosecutors must gather enough evidence to bring formal charges at trial. Mauricio’s defense will have the opportunity to challenge the evidence during that process.

Gender Violence Cases in Baja California

Baja California created its specialized gender violence prosecutor’s office to handle cases involving domestic abuse, femicides, and related crimes. The office operates independently from the state’s general prosecutor and focuses specifically on violence against women. Ensenada, the state’s third-largest city with roughly 540,000 residents, falls under its jurisdiction alongside Tijuana, Mexicali, and other municipalities.

The victim’s current medical condition was not disclosed in the report. Originally reported by Ensenada.net.
