Baja California’s FGE (state attorney general’s office) formally charged a 24-year-old man identified as Humberto N. with aggravated rape of a 4-year-old girl on Wednesday. A control judge ordered the suspect held in preventive detention and set a three-month deadline for prosecutors to complete their investigation.
Suspect Detained at Rehabilitation Center
Authorities detained Humberto N. at a rehabilitation center before his arraignment. The suspect is accused of sexually assaulting his 4-year-old niece while she was in his care. The child reportedly described the alleged assault to her mother, telling her that her uncle had forced her to engage in illicit acts and inappropriate touching.
The victim’s mother, Cinthya Calderón, had protested at the prosecutor’s office on Monday to demand judicial action. After Wednesday’s ruling, she said she felt relief but vowed to continue pursuing a full conviction.
Mother Responds to Social Media Criticism
Calderón also addressed criticism she had received on social media from users who blamed her for leaving her children with her brother. She said working mothers depend on family support for childcare and should not face blame when a relative commits a crime against their child.
Under Mexico’s federal penal code, aggravated rape involving a minor carries a sentence of up to 23 years in prison. The charge is classified as “aggravated” because the victim is under 15 years old and the accused held a position of trust as a family member.
Baja California’s criminal justice system follows an accusatorial model adopted nationwide in 2016. In this system, the vinculación a proceso (formal charging) stage does not determine guilt. It establishes that prosecutors have enough evidence to proceed to trial. The three-month investigative period gives the FGE time to gather testimony, forensic evidence, and any additional documentation before a trial date is set.
The case remains under active investigation. Prosecutors have until late June to complete their work before the next hearing, as reported by the Imperial Valley Press.
