A La Paz judge ordered pretrial detention for José Alfredo N. after prosecutors presented evidence that the man drove drunk, crossed into oncoming traffic, and killed another driver in a head-on collision on the transpeninsular highway near Chametla.

The crash occurred on the La Paz to Ciudad Insurgentes stretch of Highway 1, near kilometer marker 13. According to prosecutors, José Alfredo N. was driving a 1988 Ford Ranger when he veered into the opposite lane and struck a 2025 Volkswagen Jetta head-on. The driver of the Jetta died at the scene.

Judge Rules Detention Lawful at April 5 Hearing

A control judge held an initial hearing on April 5, where prosecutors from the Baja California Sur Attorney General’s Office (FGE) presented their case. The judge ruled that the detention was lawful and the evidence sufficient to formally bind the suspect to the criminal process. The court then imposed preventive detention, meaning José Alfredo N. will remain jailed while the case moves forward.

Under Mexican criminal procedure, preventive detention (prisión preventiva) keeps defendants in custody when a judge determines there is a flight risk or danger to the community. In drunk-driving homicide cases, this measure is not automatic and requires a specific judicial finding.

Victim’s Family Feared Suspect Would Go Free

The case drew public attention after relatives of the victim expressed concern that the suspect might be released on provisional liberty (libertad provisional), a form of conditional release. The victim reportedly worked at the Baja California Sur state legislature, though his name has not been officially released.

The family’s public appeal put pressure on prosecutors to pursue the strongest possible custodial measure. The pretrial detention ruling means José Alfredo N. cannot post bail or leave custody while the investigation and trial proceed.

A Key Route for La Paz Travelers

The La Paz to Ciudad Insurgentes corridor is one of the most traveled sections of the transpeninsular highway in southern Baja California Sur. Drivers heading north from La Paz toward Loreto, Mulegé, or connecting routes to the Pacific coast use this road daily. The Chametla area sits just south of La Paz, making it a frequent transit point for both local commuters and long-distance travelers.

Drunk-driving crashes on two-lane stretches of Highway 1 are particularly dangerous because there is no physical median separating opposing lanes of traffic. Wrong-way collisions at highway speed are often fatal.

The charge filed against José Alfredo N. is homicidio culposo, the Mexican legal equivalent of negligent homicide or vehicular manslaughter. If convicted, sentencing will depend on aggravating factors, including the level of intoxication at the time of the crash.
