Prosecutors in Baja California Sur have formally charged a Cabo San Lucas man with two counts of aggravated sexual assault and ordered him held in pretrial detention, the state Attorney General’s Office (PGJE) announced.
The suspect, identified as Marco Antonio “N” under Mexican privacy laws that withhold full surnames of the accused, was arrested on March 28 in the Colonia Cangrejos neighborhood of Cabo San Lucas. A judge had issued an arrest warrant prior to the detention.
Alleged Assaults Occurred in Colonia 4 de Marzo
According to the PGJE, the two alleged offenses took place between May and July 2025 at a residence in the Colonia 4 de Marzo neighborhood. Colonia 4 de Marzo is a residential area on the north side of Cabo San Lucas, inland from the tourist corridor.
The charges carry the “aggravated” designation under Baja California Sur’s penal code, which typically applies when specific circumstances surround the assault, such as a relationship of trust or authority between the suspect and victim, or the use of force or intimidation. Mexican law does not publicly identify victims in sexual violence cases.
Pretrial Detention Ordered by Judge
A control judge reviewed the evidence presented by PGJE prosecutors and determined that pretrial detention was warranted. Under Mexico’s criminal justice system, pretrial detention (prisión preventiva) can be imposed for serious offenses when a judge finds risk of flight or danger to the victim.
The suspect will remain in custody at a facility in the Los Cabos municipality while the case proceeds through the courts. Mexican criminal proceedings can take months or longer before reaching trial.
The PGJE did not release details about what led investigators to identify Marco Antonio “N” as a suspect or whether additional charges could follow. The office has encouraged victims of sexual violence in Baja California Sur to report crimes through its offices or by calling 612-122-5939.
